A recent legislative change has taken effect this month, significantly affecting pet owners who may now face imprisonment for administering medicinal gummies to their pets.
As of January 1, Alabama has implemented new regulations that impose restrictions on the use of certain hemp products.
This legislation is primarily perceived as affecting consumers who purchase gummies and beverages; however, it also extends its reach to pets and their caregivers.
The Alabama Alcoholic Beverage Management Board now regulates hemp products containing Delta-8 or CBD,which can only be sold by licensed vendors.
Understanding the New Regulations
The law defines “consumable hemp products” as items intended for human or animal consumption that contain any part of the hemp plant. This includes products infused with cannabinoids such as CBD.
Impact on Pet Stores and Owners
Due to these regulatory changes, pet retailers are no longer permitted to stock items commonly used to alleviate joint pain and other health issues in beloved pets. These products have been widely utilized by pet owners seeking relief for their animals suffering from anxiety or discomfort through calming treats or tinctures.Attorney Whitt Steineker highlighted this concern in an article for The national Law Review.
Steineker further noted that pet stores will not qualify for the special licensing required under this new law to sell such items. Consequently, if pet owners are found possessing calming gummies after these regulations have come into effect, they could face felony charges.
Potential Consequences
The ramifications include possible incarceration, according to Steineker’s warnings. Additionally, offenders may incur fines reaching up to $15,000.
