The Pennsylvania house of Representatives has recently passed a bill known as House Bill 97.If enacted, this law would officially classify pets as “living beings that are generally regarded as beloved family members providing companionship, protection, and support.”
Defining Companion Animals
This legislation seeks to establish a formal definition for companion animals, thereby enhancing their legal standing in divorce proceedings. The bill states: “companion animals possess a unique classification distinct from inanimate property. Thus, it is indeed the policy of the Commonwealth to extend special consideration to companion animals during property division.”

Guidelines for Shared Custody Arrangements
The proposed legislation introduces new guidelines regarding shared custody arrangements and financial responsibilities associated with pet care.
Factors Influencing Pet Custody Decisions
This new framework instructs judges to consider various factors similar to those used in child custody disputes—such as who provides daily care for the pet, who takes them for veterinary visits, and wich party has greater financial resources available for their upkeep.
Sponsorship and Support for the Bill
This initiative was championed by State Representative Anita Astorino Kulik (D-Pa.), who serves Pennsylvania’s 45th District.

“In my years practicing Family Law,” Kulik stated via her September Facebook post, “I observed that one major point of contention among divorcing couples was often pet custody. For many individuals, our furry companions are not just ‘pets’; they are vital parts of our families.”

Kulik expressed her gratitude stating: “I am thrilled that my bill received overwhelming support from the House of Representatives! I appreciate my colleagues who voted favorably on this important measure along with advocacy groups that backed this initiative.”
The proposal is currently under review by the Pennsylvania Senate.
